Family law covers disputes between spouses, parents, and family members — most commonly divorce, judicial separation, child custody and guardianship, maintenance and alimony, and protection from domestic violence. In India, the governing law depends on personal religious law: the Hindu Marriage Act, 1955 applies to Hindus, Sikhs, Jains and Buddhists; the Special Marriage Act, 1954 covers inter-faith and civil marriages; Muslim personal law (as recognised under the Shariat Application Act, 1937) governs Muslim marriages and divorce; and the Indian Divorce Act, 1869 applies to Christians.

A divorce petition can be filed on fault grounds (cruelty, desertion, adultery, and similar) or by mutual consent, which is generally faster but still requires a minimum statutory waiting period and two court appearances. Child custody is decided on the "welfare of the child" standard under the Guardians and Wards Act, 1890, rather than automatically favouring either parent. Maintenance can be claimed by a spouse or children under personal law, or under the more general Section 144 of the Bharatiya Nagarik Suraksha Sanhita (the provision that replaced Section 125 CrPC). Domestic violence — physical, emotional, verbal, or economic — is separately actionable under the Protection of Women from Domestic Violence Act, 2005, which allows for protection orders, residence orders, and monetary relief even without filing for divorce.

Most family court proceedings begin with an attempt at mediation or conciliation before contested litigation proceeds, and courts increasingly encourage settlement wherever possible. Timelines vary widely depending on whether the matter is contested and how backlogged the local family court is.
